CHAPTER XV. UTILITIESCHAPTER XV. UTILITIES\ARTICLE 9. LEVELIZED UTILITY PAYMENT PROGRAM

The city of Oakley will offer a levelized payment option which allows utility customers to pay the same amount every month for their city utilities for a period of one year.

(Ord. 906; Code 1974, Chapter 13.44; Code 2014)

Customers must have a good credit history wherein nine of the past twelve utility bills were paid before the delinquent date. If the customer is new, they must have a minimum of six months history with no more than one delinquent payment during that time. If the customer has had a water meter disconnected within the twelve months preceding the agreement year, they will not be eligible for the plan.

(Ord. 906; Code 1974, Chapter 13.44; Code 2014)

All utility payments must be made before the delinquent date. In the event of a late payment, the city shall have the right to terminate the agreement and revert the account to regular pay and the account will be settled.

(Ord. 906; Code 1974, Chapter 13.44; Code 2014)

The property owner must sign the levelized utility payment agreement if the account is for a rental property.

(Ord. 906; Code 1974, Chapter 13.44; Code 2014)

The city of Oakley shall have the right to adjust the levelized payment with a minimum of forty-five days notice to the customer. If the adjustment is not agreeable with the customer, the levelized pay plan may be discontinued with the account being settled.

(Ord. 906; Code 1974, Chapter 13.44; Code 2014)

At the end of the one year period, if the customer continues on the level pay program, the debit or credit balance will be used in the calculation of a new level pay amount. If the customer does not continue on the program, the following adjustments will be made: a credit balance would be applied to future bills or the customer can request a refund check; a debit balance would become due with the next utility bill.

(Ord. 906; Code 1974, Chapter 13.44; Code 2014)

The one year period for the levelized utility payment program would begin on November 1st of each year.
