The governing body of the City of Oakley, Kansas, finds that parking and operating motor vehicles on certain streets covered by a heavy accumulation of snow is a matter affecting the health, safety and welfare of the citizens of the city, for the reasons that parked and stalled vehicles impede snow removal operations and cause serious traffic congestion.

Whenever snow has accumulated, or there is a possibility of snow, or forecasted accumulation of snow, to such a depth that snow removal operations are likely, the mayor, or his or her designee, may declare a traffic emergency by 1:00 P.M. on the day of such emergency; and unless an extension is declared, such traffic emergency shall expire eighteen hours after the snow has ceased.

All vehicles and trailers parked on emergency snow routes must be removed within three hours after notice of a traffic emergency has been given. Any vehicle or trailer parked on an emergency snow route after such period of time may be removed, or caused to be removed, by a police officer to the nearest garage or other place of safety, and the vehicle or trailer may not be recovered until the towing and storage charges are paid. Provided that, before any vehicle or trailer is so removed, police department personnel shall make a reasonable attempt to personally notify the owner or operator of such vehicle or trailer and request its immediate removal from the emergency snow route by said owner or operator.

Emergency snow routes and priority sanding areas shall be designated in writing by the street department director on or before September 30 of each year and filed with the city clerk, to be incorporated in the city's winter storm procedure, and on or before October 31 of each year, emergency snow route signs shall be installed on the emergency snow routes in accordance with said designation.
