A CHARTER ORDINANCE AMENDING AND REPEALING SECTION 2 OF CHARTER ORDINANCE NO. 27, EXEMPTING THE CITY OF OAKLEY, KANSAS, FROM CERTAIN PORTIONS OF K.S.A 12-1697 RELATING TO THE LEVY OF A TRANSIENT GUEST TAX.

Be It Ordained By the Governing Body of the City of Oakley, Kansas:

WHEREAS, K.S.A. 12-1697 authorizes a levy by cities of a transient guest tax, which provisions are not uniformly applicable to all cities; and

WHEREAS, pursuant to Article 12, Section 5 of the Constitution of the State of Kansas, cities may exempt themselves from such provisions and provide substitute and additional provisions therefore; and

WHEREAS, the City of Oakley, Kansas, has adopted Charter Ordinance No. 27, on October 19, 2015, dealing with said subjects;

NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OAKLEY, KANSAS:

SECTION 1. That Section 2 of City of Oakley, Kansas, Charter Ordinance No. 27, as passed on October 19, 2015, is here by amended to read as follows:

       SECTION 2: In place of that portion of K.S.A. 12-1697 referred to above, the governing body of the City of Oakley, Kansas, hereby levies a transient guest tax at not to exceed the rate of five percent (5%) upon the gross receipts derived from or paid by transient guests for sleeping accommodations exclusive of charges for incidental services of facilities in any hotel, motel or tourist court. The percentage and effective date of such tax shall be determined by the Governing Body and shall be specified in a resolution authorizing the same and may be amended, within the limits specified herein, from time to time by resolution of the Governing Body. All other provisions of K.S.A. 12-1697 shall remain in effect for the City of Oakley.

SECTION 2: Section 2 of the City of Oakley, Kansas Charter Ordinance No. 27, as passed on October 19, 2015, is hereby repealed.
