A CHARTER ORDINANCE EXEMPTING THE CITY OF OAKLEY, KANSAS, FROM CERTAIN PORTIONS OF K.S.A. 12-1697, K.S.A. 12-1695 AND K.S.A. 12-16,101 AND REPEALING CHARTER ORDINANCE NO. 14.
Be It Ordained By the Governing Body of the City Of Oakley, Kansas:
SECTION 1: The City
of Oakley, Kansas, is a city of the third class, and by the power vested in it
by Article XII, Section 5, of the Constitution of the State of Kansas, hereby elects
to exempt, and does hereby exempt itself, from, and make inapplicable to it,
that portion of K.S.A. 12-1697, which authorizes the levy of a transient guest
tax at not to exceed the rate of two percent (2%) upon the gross receipts
derived from or paid by transient guests for sleeping accommodations exclusive
or charges for incidental services or facilities in any hotel, motel or tourist
court, 12-1695 and 12-16,101, which establishes a ten (10) member committee, a
majority of which shall be representatives of businesses coming from within the
terms of this act. Said statute not being uniformly applicable to all cities in
Kansas.
SECTION 2: In place
of that portion of K.S.A. 12-1697 referred to above, the governing body of the
City of Oakley, Kansas, is hereby authorized to levy a transient guest tax at
not to exceed the rate of four percent (4%) upon the gross receipts derived
from or paid by transient guests for sleeping accommodations exclusive of
charges for incidental services of facilities in any hotel, motel or tourist
court.
SECTION 3: All other
provisions of K.S.A. 12-1697 shall remain the same.
SECTION 4: In place
of that portion of K.S.A. 12-1695 and K.S.A. 12-16,101 referred to above, the
mayor of the City of Oakley, Kansas, shall appoint a Board of the Convention
and Tourism activities which shall be composed of three (3) members who shall
serve without compensation for four (4) years in staggered terms.
SECTION 5: All other
provisions of K.S.A. 12-1695 and K.S.A. 12-16,101 shall remain the same.
SECTION 6: week for
two (2) newspaper. This ordinance shall be published once each consecutive
weeks in the official city
SECTION 7: Charter Ordinance #14 is hereby repealed.
