A CHARTER ORDINANCE EXEMPTING THE CITY OF OAKLEY, KANSAS FROM K.S.A. 12- 1692 through 12-16,101, and providing substitute and additional provisions on the same subject.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OAKLEY. KANSAS:
SECTION 1:
EXEMPTION. The City of Oakley, Kansas, a city of the third class by the power vested
in it by Article 12, Section 5, of the Constitution of the State of Kansas,
hereby elects to exempt itself from and make inapplicable to the City of
Oakley, the provisions of K.S.A. 12-1691 through 12-16,101, as amended, and
provides substitute and additional provisions as hereinafter provided.
SECTION 2: K.S.A.
12-1692(e) and K.S.A. 12-1696(e), contain a definition of convention and tourism
promotion. This definition provides as follows: “Convention and tourism
promotion” means: (I) Activities to attract visitors into the community through
marketing efforts, including advertising, directed to at least one of the five
basic convention and tourism market segments consisting of group tours,
pleasure travelers, association meetings and conventions, trade shows and corporate
meetings in travel; and (2) support of those activities and organizations which
encourage increased lodging facility occupancy. K. S.A. 12 -1698(e) provides except
as otherwise provided in K.S.A. 12-1774, and amendments thereto, all such
monies received by the county or city treasurer from disbursements from the
county or city transient guest tax fund shall be credited to the tourism and
convention promotion fund of such county or city and shall only be expended for
convention and tourism promotion.
SECTION 3: The City
of Oakley, Kansas, hereby modifies the definition contained in K.S.A. 12- 1696(e)
and 12-1692(e) to read as follows: “Convention and tourism promotion” means: (1) Activities to attract visitors into
the community through marketing efforts, including advertising, directed to at
least one of the five basic convention and tourism market segments consisting
of group tours, pleasure travelers, association meetings and conventions, trade
shows and corporate meetings in travel; and (2) support of those activities and
organizations which encourage increased lodging facility occupancy; and (3)
support of infrastructure to maintain attractions for travel and tourism, including
the expenditure of funds from the tourism and convention promotion fund for
those purposes.
