A CHARTER ORDINANCE EXEMPTING THE CITY OF OAKLEY, KANSAS FROM K.S.A. 12-1692 et seq., and providing substitute and additional provisions on the same subject.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OAKLEY, KANSAS:

SECTION 1: EXEMPTION. The City of Oakley, Kansas, a City of the third class by the power vested in it by Article 12. Section 5, of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to the City of Oakley the provisions of K.S.A. 12-1691 through 12-16,101, as amended, and provides substitute and additional provisions as hereinafter provided.

SECTION 2: K.S.A. 12-16,101 calls for the establishment of a “convention and tourism committee”, which has been established by the City. The convention and tourism committee for the City of Oakley shall be known as the “Tourism and Convention Board.”

SECTION 3: K.S.A. 12-16,101 states that the committee shall consist often (10) members. The City of Oakley, Kansas, hereby modifies the requirements of K.S.A. 12-16.101, as follows:

A.    The Board shall consist of seven (7) members. The City Administrator or a City Council member may sit on the Board as an ex-officio member. The Mayor will make appointments to the Tourism and Convention Board and the recommendations will be subject to the approval of the Governing Body of the City Council, as required by law. Each member of the Tourism and Convention Board shall be a representative of one of the following groups:

1      Owners, operators or employees of persons engaged in the hotel or motel business within the City, whether such members reside inside or outside the City.

2      Representatives from agencies or organizations actively engaged in promoting tourism, or from facilities or organizations of historic or cultural attraction in the City or its environs;

3      Members of the general public;

4      Owners, operators or employees of persons engaged in food services or hospitality industry.

B.    In making appointments to the Tourism Board, the Mayor shall designate which group the appointed member is to represent. No more than three representatives from anyone of the above groups shall be members of the Tourism Board at any one time. The Tourism and Convention Board shall hold regular meetings at a time and place to be established by the Board. The Tourism and Convention Board shall elect a chairman and secretary.

C.    If this Charter Ordinance is adopted by the City Council, a final Resolution shall be adopted, pursuant to K.S.A. 12-16,101, establishing the method of appointment and the length of the term of the members. The length of the term shall not exceed four years.
